Mediation Types
Mediation can either be binding or facilitative.
- In binding mediation, an arbitrator is given authority to render a decision on the matter.
- In facilitative mediation, the parties are empowered to reach their own agreement. It is effective when parties have reached an impasse or when there are personal conflicts, poor communication, imbalances of power or inflexible negotiating postures. It is informal and a fraction of the cost of a civil proceeding.
In this process, parties control the scope of their discussions and any agreement reached. A third party neutral generally assists in identifying and clarifying the issues.
